За незаконну зйомку об’єктів залізниці може бути кримінальна відповідальність: нагадуємо правила

Не кожне фото чи відео на залізниці — просто контент. В умовах війни навіть окремі деталі в кадрі можуть розкривати інформацію, яка становить інтерес для ворога та створює ризики для безпеки залізниці.

Залізничний транспорт законодавством віднесений до підсектору залізничного транспорту сектору транспорту і пошти критичної інфраструктури. Це визначено Законом України «Про критичну інфраструктуру» та постановою Кабінету Міністрів України № 1109.

Депо, станції, об’єкти енергетики, сигналізації та зв’язку, рухомий склад та інші об’єкти можуть містити чутливу інформацію про їхнє розташування, стан, технічні характеристики та особливості роботи. За фото чи відео можна визначити характер і масштаби пошкоджень, розміщення техніки та рухомого складу. В умовах війни такі дані можуть бути використані ворогом.

Тому не варто самостійно проникати на територію депо, підстанцій, місць ворожих ударів чи інших об’єктів залізничної інфраструктури заради фото або відео.

У разі виявлення таких випадків Укрзалізниця невідкладно вживає заходів для їх припинення. За потреби на місце викликаються правоохоронці, а інформація про порушників передається до відповідних органів для надання правової оцінки їхнім діям та притягнення винних осіб до відповідальності.

А якщо під час зйомки в кадр потрапить інформація про переміщення військових, техніки чи озброєння залізницею — за поширення таких матеріалів може загрожувати кримінальна відповідальність, аж до 8 років позбавлення волі.

Illegal filming of railway infrastructure may result in criminal liability: a reminder of the rules

Not every photo or video taken on railway premises is simply “content.” During wartime, even seemingly minor details in a frame may reveal information of interest to the enemy and create security risks for the railway.

Under Ukrainian law, railway transport is classified as a subsector of the transport and postal sector of critical infrastructure. This is established by the Law of Ukraine “On critical infrastructure” and Resolution No. 1109 of the Cabinet of Ministers of Ukraine.

Railway depots, stations, energy facilities, signalling and communications infrastructure, rolling stock, and other facilities may contain sensitive information about their location, condition, technical characteristics, and operational specifics. Photos and videos may reveal the nature and extent of damage, as well as the location of equipment and rolling stock. During wartime, such information may be exploited by the enemy.

Therefore, people should not enter railway depots, substations, sites hit by enemy attacks, or other railway infrastructure facilities without authorization for the purpose of taking photos or videos.

When such cases are identified, JSC “Ukrainian railways” takes immediate measures to stop them. If necessary, law enforcement officers are called to the scene, and information about the individuals involved is provided to the relevant authorities for legal assessment of their actions and potential prosecution.

It is particularly crucial and critical to remember that if filming captures information about the movement of military personnel, equipment, or weapons by rail, distributing such materials may result in criminal liability, including imprisonment for up to 8 years.
